Člen 23 - Enakost žensk in moških

Enakost žensk in moških se mora zagotoviti na vseh področjih, vključno z zaposlovanjem, delom in plačilom za delo.
Načelo enakosti ne preprečuje ohranitve ali sprejetja ukrepov o specifičnih ugodnostih v korist nezadostno zastopanega spola.

    Prvi odstavek tega člena temelji na členih 2 in 3(2) Pogodbe ES, ki sta ju sedaj nadomestila člen 3 Pogodbe o Evropski uniji in člen 8 Pogodbe o delovanju Evropske unije, ki Uniji zastavljata cilj spodbujati enakost med ženskami in moškimi, in na členu 157(1) Pogodbe o delovanju Evropske unije. Izhaja iz 20. člena spremenjene Evropske socialne listine z dne 3. maja 1996 in iz točke 16 Listine Skupnosti o pravicah delavcev.
    Prav tako temelji na členu 157(3) Pogodbe o delovanju Evropske unije in na členu 2(4) Direktive Sveta 76/207/EGS o izvrševanju načela enakega obravnavanja moških in žensk v zvezi z dostopom do zaposlitve, poklicnega usposabljanja in napredovanja ter delovnih pogojev.
    Drugi odstavek na kratko povzema člen 157(4) Pogodbe o delovanju Evropske unije, ki določa, da načelo enakega obravnavanja ne preprečuje ohranitve ali sprejetja ukrepov o specifičnih ugodnostih, s katerimi se nezadostno zastopanemu spolu olajša opravljanje poklicne dejavnosti ali prepreči ali izravna neugoden položaj v poklicni karieri. V skladu s členom 52(2) ta odstavek ne spreminja člena 157(4).

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    V nadaljevanju navedena pojasnila so bila prvotno pripravljena pod vodstvom predsedstva Konvencije, ki je sestavilo Listino Evropske unije o temeljnih pravicah. Ta pojasnila so bila posodobljena pod vodstvom predsedstva Evropske konvencije zaradi prilagoditve besedila Listine s strani omenjene konvencije (zlasti členov 51 in 52) in nadaljnjega razvoja prava Unije. Čeprav sama nimajo pravne veljave, so dragocena pomoč pri razlagi in pojasnjevanju določb Listine.

The Council of Ministers and the Governments of the Communities and the Regions include both women and men. The law, federate law or rule referred to in Article 134 provides for women and men to sit on the permanent deputations of the provincial councils, the colleges of the burgomasters and aldermen, the councils and permanent committees of the social welfare centres and on the executives of any other inter-provincial, supra-municipal, inter-municipal or intra-municipal territorial body. The preceding paragraph does not apply when the law, federate law or rule referred to in Article 134 provides for the direct election of the members of the permanent deputations of the provincial councils, of aldermen, of the members of the councils and permanent committees of the social welfare centres or of the members of the executives of any other inter-provincial, supra-municipal, inter-municipal or intra-municipal territorial body.

Gleiches gilt für Titel, akademische Grade und Berufsbezeichnungen.

Measures to promote factual equality of women and men, particularly by eliminating actually existing inequalities, are admissible.(3) Official designations can be applied in such a way as to indicate the sex of the officer holder. The same holds good for titles, academic degrees and descriptions of occupations.
