Artikolu 17 - Id-dritt għall-proprjetà

1. Kull persuna għandha d-dritt li tgawdi mill-proprjetà tal-beni tagħha li tkun akkwistat legalment, li tużahom, li tiddisponi minnhom u li tħallihom bħala wirt. L-ebda persuna ma tista' tiġi mċaħħda mill-proprjetà tagħha, ħlief fl-interess pubbliku u fil-każijiet u skond il-kondizzjonijiet previsti mil-liġi, bi ħlas ta' kumpens xieraq fi żmien utli għal dak li tkun tilfet. L-użu tal-proprjetà jista' jiġi rregolat bil-liġi safejn ikun meħtieġ għall-interess pubbliku.
2. Il-proprjetà intellettwali għandha tiġi protetta.

    Dan l-Artikolu hu bbażat fuq l-Artikolu 1 tal-Protokoll tal-KEDB:
    `Kull persuna naturali jew persuna morali għandha dritt għat-tgawdija paċifika tal-possedimenti tagħha. Ħadd ma għandu jiġi pprivat mill-possedimenti tiegħu ħlief fl-interess pubbliku u bla ħsara tal-kundizzjonijiet provduti bil-liġi u bil-prinċipji ġenerali tal-liġi internazzjonali.
    Iżda d-dispożizzjonijiet ta' qabel ma għandhom b'ebda mod inaqqsu d-dritt ta' Stat li jwettaq dawk il-liġijiet li jidhrulu xierqa biex jikkontrolla l-użu ta' proprjetà skond l-interess ġenerali jew biex jiżgura l-ħlas ta' taxxi jew kontribuzzjonijiet oħra jew pieni`.
    Dan hu dritt fundamentali komuni għall-kostituzzjonijiet nazzjonali kollha. Huwa ġie rikonoxxut bosta drabi mill-każistika tal-Qorti tal-Ġustizzja, l-ewwel nett fis-sentenza Hauer ( 13 ta' Diċembru 1979, Ġabra 1979, p. 3727). Il-kliem ġie aġġornat iżda, skond l-Artikolu 52(3), is-sens u l-ambitu tad-dritt huma l-istess bħal dawk tad-dritt garantit mill-KEDB u l-limitazzjonijiet ma jistgħux jeċċedu dawk previsti hemmhekk.
    Il-protezzjoni tal-proprjetà intellettwali, li huwa aspett wieħed mid-dritt għall-proprjetà, hu msemmi espliċitament fil-paragrafu 2 minħabba li qed isir dejjem aktar importanti u fil-leġislazzjoni sekondarja tal-Komunità. Il-proprjetà intellettwali tkopri mhux biss il-proprjetà letterarja u artistika, iżda wkoll, inter alia, id-drittijiet ta' privattiva u trademarks u drittijiet simili. Il-garanziji stabbiliti fil-paragrafu 1 għandhom japplikaw kif xieraq għall-proprjetà intellettwali.

    Dawn l-ispjegazzjonijiet ġew imħejjija oriġinarjament taħt ir-responsabbiltà tal-Praesidium tal-Konvenzjoni li abbozza l-Karta tad-Drittijiet Fundamentali ta' l-Unjoni Ewropea. Huma ġew aġġornati taħt ir-responsabbiltà tal-Praesidium tal-Konvenzjoni Ewropea, fid-dawl ta' l-aġġustamenti li saru għat-test tal-Karta minn dik il-Konvenzjoni (partikolarment fl-Artikoli (51 U 52) u ta' l-evoluzzjoni fil-liġi ta' l-Unjoni. Għalkemm dawn l-ispjegazzjonijiet m'għandhomx fihom infushom l-istatus ta' liġi, huma mezz siewi ta' interpretazzjoni intiż sabiex ikunu ċċarati d-dispożizzjonijiet tal-Karta.

    Article 17 (1). Property is under the protection of the State; rights deriving there from, however, may not be exercised contrary to the public interest. (2). No one shall be deprived of his property except for public benefit which must be duly proven, when and as specified by statute and always following full compensation corresponding to the value of the expropriated property at the time of the court hearing on the provisional determination of compensation. In cases in which a request for the final determination of compensation is made, the value at the time of the court hearing of the request shall be considered. If the court hearing for the final determination of compensation takes place after one year has elapsed from the court hearing for the provisional determination, then, for the determination of the compensation the value at the time of the court hearing for the final determination shall be taken into account. In the decision declaring an expropriation, specific justification must be made of the possibility to cover the compensation expenditure. Provided that the beneficiary consents thereto, the compensation may be also paid in kind, especially in the form of granting ownership over other property or of granting rights over other property. (3). Any change in the value of expropriated property occurring after publication of the act of expropriation and resulting exclusively there from shall not be taken into account. (4). Compensation is determined by the competent courts. Such compensation may also be determined provisionally by the court after hearing or summoning the beneficiary, who may be obliged, at the discretion of the court, to furnish a commensurate guarantee in order to collect the compensation, as provided by the law. Notwithstanding article 94, a law may provide for the establishment of a uniform jurisdiction, for all disputes and cases relating to expropriation, as well as for conducting the relevant trials as a matter of priority. The manner in which pending trials are continued, may be regulated by the same law. Prior to payment of the final or provisional compensation, all rights of the owner shall remain intact and occupation of the property shall not be allowed. In order for works of a general importance for the economy of the country to be carried out, it is possible that, by special decision of the court which is competent for the final or the provisional determination of the compensation, the execution of works even prior to the determination and payment of the compensation is allowed, provided that a reasonable part of the compensation is paid and that full guarantee is provided in favour of the beneficiary of the compensation, as provided by law. Thesecond period of the first section applies accordingly also to these cases. Compensation in the amount determined by the court must in all cases be paid within one and one half years at the latest from the date of publication of the decision regarding provisional determination of compensation payable, and in cases of a direct request for the final determination of compensation, from the date of publication of the court ruling, otherwise the expropriation shall be revoked ipso jure. The compensation as such is exempt from any taxes, deductions or fees. (5). The cases in which compulsory compensation shall be paid to the beneficiaries for lost income from expropriated property until the time of payment of the compensation shall be specified by law. (6). In the case of execution of works serving the public benefit or being of a general importance to the economy of the country, a law may allow the expropriation in favour of the State of wider zones beyond the areas necessary for the execution of the works. The said law shall specify the conditions and terms of such expropriation, as well as the matters pertaining to the disposal for public or public utility purposes in general, of areas expropriated in excess of those required. (7). The digging of underground tunnels at the appropriate depth without compensation, may be allowed by law for the execution of works of evident public utility for the State, public law legal persons, local government agencies, public utility agencies and public enterprises, on condition that the normal exploitation of the property situated above shall not be hindered.

Κανένας δεν στερείται την ιδιοκτησία του, παρά μόνο για δημόσια ωφέλεια που έχει αποδειχθεί με τον προσήκοντα τρόπο, όταν και όπως ο νόμος ορίζει, και πάντοτε αφού προηγηθεί πλήρης αποζημίωση, που να ανταποκρίνεται στην αξία την οποία είχε το απαλλοτριούμενο κατά το χρόνο της συζήτησης στο δικαστήριο για τον προσωρινό προσδιορισμό της αποζημίωσης. Αν ζητηθεί απευθείας ο οριστικός προσδιορισμός της αποζημίωσης, λαμβάνεται υπόψη η αξία κατά το χρόνο της σχετικής συζήτησης στο δικαστήριο. Αν η συζήτηση για τον οριστικό προσδιορισμό της αποζημίωσής διεξαχθεί μετά την παρέλευση έτους από τη συζήτηση για τον προσωρινό προσδιορισμό, τότε για τον προσδιορισμό της αποζημίωσης λαμβάνεται υπόψη η αξία κατά το χρόνο της συζήτησης για τον οριστικό προσδιορισμό. Στην απόφαση κήρυξης πρέπει να δικαιολογείται ειδικά η δυνατότητα κάλυψης της δαπάνης αποζημίωσης. Η αποζημίωση, εφόσον συναινεί ο δικαιούχος, μπορεί να καταβάλλεται και σε είδος ιδίως με τη μορφή της παραχώρησης της κυριότητας άλλου ακινήτου ή της παραχώρησης δικαιωμάτων επί άλλου ακινήτου. (3). Η ενδεχόμενη μεταβολή της αξίας του απαλλοτριουμένου μετά τη δημοσίευση της πράξης απαλλοτρίωσης, και μόνο εξαιτίας της, δεν λαμβάνεται υπόψη. (4). Η αποζημίωση ορίζεται από τα αρμόδια δικαστήρια. Μπορεί να οριστεί και προσωρινά δικαστικώς, ύστερα από ακρόαση ή πρόσκληση του δικαιούχου, που μπορεί να υποχρεωθεί κατά την κρίση του δικαστηρίου να παράσχει για την είσπραξή της ανάλογη εγγύηση, σύμφωνα με τον τρόπο που ορίζει ο νόμος. Νόμος μπορεί να προβλέπει την εγκαθίδρυση ενιαίας δικαιοδοσίας, κατά παρέκκλιση από το Αρθ-94, για όλες τις διαφορές και υποθέσεις που σχετίζονται με απαλλοτρίωση, καθώς και την κατά προτεραιότητα διεξαγωγή των σχετικών δικών. Με τον ίδιο νόμο μπορεί να ρυθμίζεται ο τρόπος με τον οποίο συνεχίζονται εκκρεμείς δίκες. Πριν καταβληθεί η οριστική ή προσωρινή αποζημίωση διατηρούνται ακέραια όλα τα δικαιώματα του ιδιοκτήτη και δεν επιτρέπεται η κατάληψη. Προκειμένου να εκτελεστούν έργα γενικότερης σημασίας για την οικονομία της Χώρας είναι δυνατόν, με ειδική απόφαση του δικαστηρίου που είναι αρμόδιο για τον οριστικό ή προσωρινό προσδιορισμό της αποζημίωσης, να επιτρέπεται η πραγματοποίηση εργασιών και πριν από τον προσδιορισμό και την καταβολή της αποζημίωσης, υπό τον όρο της καταβολής εύλογου τμήματος της αποζημίωσης και της παροχής πλήρους εγγύησης υπέρ του δικαιούχου της αποζημίωσης, όπως νόμος ορίζει. Η δεύτερη πρόταση του εδαφ.1 εφαρμόζεται αναλόγως και στις περιπτώσεις αυτές. Η αποζημίωση που ορίστηκε καταβάλλεται υποχρεωτικά το αργότερο μέσα σε ενάμισι έτος από τη δημοσίευση της απόφασης για τον προσωρινό προσδιορισμό της αποζημίωσης και, σε περίπτωση απευθείας αίτησης για οριστικό προσδιορισμό της αποζημίωσης, από τη δημοσίευση της σχετικής απόφασης του δικαστηρίου, διαφορετικά η απαλλοτρίωση αίρεται αυτοδικαίως. Η αποζημίωση δεν υπόκειται, ως αποζημίωση, σε κανένα φόρο, κράτηση ή τέλος. (5). Νόμος ορίζει τις περιπτώσεις υποχρεωτικής ικανοποίησης των δικαιούχων για την πρόσοδο, την οποία έχασαν από το ακίνητο που απαλλοτριώθηκε έως το χρόνο καταβολής της αποζημίωσης. (6). 'Οταν πρόκειται να εκτελεστούν έργα κοινής ωφέλειας ή γενικότερης σημασίας για την οικονομία της Χώρας, νόμος μπορεί να επιτρέψει την απαλλοτρίωση υπέρ του Δημοσίου ευρύτερων ζωνών, πέρα από τις εκτάσεις που είναι αναγκαίες για την κατασκευή των έργων. Ο ίδιος νόμος καθορίζει τις προϋποθέσεις και τους όρους μιας τέτοιας απαλλοτρίωσης, καθώς και τα σχετικά με τη διάθεση ή χρησιμοποίηση, για δημόσιους ή κοινωφελείς γενικά σκοπούς, των εκτάσεων που απαλλοτριώνονται επιπλέον όσων είναι αναγκαίες για το έργο που πρόκειται να εκτελεστεί. (7). Νόμος μπορεί να ορίσει ότι για την εκτέλεση έργων με προφανή κοινή ωφέλεια υπέρ του Δημοσίου, νομικών προσώπων δημοσίου δικαίου, οργανισμών τοπικής αυτοδιοίκησης, οργανισμών κοινής ωφέλειας και δημόσιων επιχειρήσεων, επιτρέπεται να διανοιχθούν υπόγειες σήραγγες στο επιβαλλόμενο βάθος, χωρίς αποζημίωση, υπό τον όρο ότι δεν θα παραβλάπτεται η συνήθης εκμετάλλευση του υπερκείμενου ακινήτου.

    Article 14 (1) Property and the right of inheritance shall be guaranteed. Their content and limits shall be defined by the laws. (2) Property entails obligations. Its use shall also serve the public good. (3) Expropriation shall only be permissible for the public good. It may only be ordered by or pursuant to a law that determines the nature and extent of compensation. Such compensation shall be determined by establishing an equitable balance between the public interest and the interests of those affected. In case of dispute concerning the amount of compensation, recourse may be had to the ordinary courts. Article 15Land, natural resources and means of production may for the purpose of socialisation be transferred to public ownership or other forms of public enterprise by a law that determines the nature and extent of compensation. With respect to such compensation the third and fourth sentences of paragraph (3) of Article 14 shall apply mutatis mutandis.

Sie darf nur durch Gesetz oder auf Grund eines Gesetzes erfolgen, das Art und Ausmaß der Entschädigung regelt. Die Entschädigung ist unter gerechter Abwägung der Interessen der Allgemeinheit und der Beteiligten zu bestimmen. Wegen der Höhe der Entschädigung steht im Streitfalle der Rechtsweg vor den ordentlichen Gerichten offen. Artikel 15 Grund und Boden, Naturschätze und Produktionsmittel können zum Zwecke der Vergesellschaftung durch ein Gesetz, das Art und Ausmaß der Entschädigung regelt, in Gemeineigentum oder in andere Formen der Gemeinwirtschaft überführt werden. Für die Entschädigung gilt Artikel 14 Abs. 3 Satz 3 und 4 entsprechend.

    Article 32. The property of every person is inviolable and equally protected. Property may be taken from the owner without his or her consent only in the public interest, in the cases and pursuant to a procedure provided by law, and for fair and immediate compensation. Everyone whose property has been taken from him or her without his or her consent has the right to bring an action in the courts to contest the taking of the property, the compensation, or the amount of the compensation.
    Everyone has the right to freedom from interference in possessing or using his or her property or making dispositions regarding the same. Limitations of this right are provided by law. Property may not be used in a manner that contravenes the public interest.
    On public interest grounds, the law may provide classes of property which may be acquired in Estonia only by citizens of Estonia, by certain categories of legal persons, by local authorities, or by the Estonian government.

    § 32. Igaühe omand on puutumatu ja võrdselt kaitstud. Omandit võib omaniku nõusolekuta võõrandada ainult seaduses sätestatud juhtudel ja korras üldistes huvides õiglase ja kohese hüvituse eest. Igaühel, kelle vara on tema nõusolekuta võõrandatud, on õigus pöörduda kohtusse ning vaidlustada vara võõrandamine, hüvitus või selle suurus. Igaühel on õigus enda omandit vabalt vallata, kasutada ja käsutada. Kitsendused sätestab seadus. Omandit ei tohi kasutada üldiste huvide vastaselt. Seadus võib üldistes huvides sätestada vara liigid, mida tohivad Eestis omandada ainult Eesti kodanikud, mõnda liiki juriidilised isikud, kohalikud omavalitsused või Eesti riik. Pärimisõigus on tagatud.
    § 39. Autoril on võõrandamatu õigus oma loomingule. Riik kaitseb autori õigusi.
