Článok 2 - Právo na život

1. Každý má právo na život.

2. Nikto nesmie byť odsúdený na trest smrti ani popravený.

  • Text:

    1. Odsek 1 tohto článku je založený na prvej vete článku 2 ods. 1 EDĽP, ktorý znie:
    `1. Právo každého na život je chránené zákonom...`
    2. Druhá veta tohto ustanovenia, ktorá sa týka trestu smrti, bola nahradená nadobudnutím platnosti článku 1 Protokolu 6 k EDĽP, ktorý znie:
    `Trest smrti sa zrušuje. Nikoho nemožno na taký trest odsúdiť ani popraviť.`
    Článok 2 ods. 2 charty je založený na tomto ustanovení.
    3. Ustanovenia článku 2 charty zodpovedajú ustanoveniam uvedených článkov EDĽP a jeho protokolov. Majú rovnaký význam a rozsah, v súlade s článkom 52 ods. 3 charty. `Negatívne` vymedzenia, ktoré sa vyskytujú v EDĽP, preto musia byť taktiež považované za súčasť charty:
    a) článok 2 ods. 2 EDĽP:
    `Zbavenie života sa nebude považovať za spôsobené v rozpore s týmto článkom, ak bude vyplývať z použitia sily, ktoré nie je viac než úplne nevyhnutné, pri:
    a) obrane každej osoby proti nezákonnému násiliu;
    b) vykonávaní zákonného zatknutia alebo zabránení úteku osoby zákonne zadržanej;
    c) zákonne uskutočnenej akcii na účely potlačenia nepokojov alebo vzbury.`;
    b) článok 2 Protokolu 6 k EDĽP:
    `Štát môže zákonom ustanoviť trest smrti za činy spáchané v čase vojny alebo bezprostrednej hrozby vojny; tento trest sa uloží iba v prípadoch, ktoré predvída zákon, a v súlade s jeho ustanoveniami...`.

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    Ďalej uvedené vysvetlivky boli pôvodne pripravené pod vedením predsedníctva konventu, ktorý vypracoval návrh Charty základných práv Európskej únie. Boli aktualizované pod vedením predsedníctva Európskeho konventu so zreteľom na úpravy, ktoré urobil tento konvent k textu charty (najmä k článkom 51 a 52), a vývoj práva Únie. Hoci tieto vysvetlivky nie sú ako také právne záväzné, predstavujú cenný nástroj výkladu, ktorý je určený na objasnenie ustanovení charty.

    (γ) επί πράξεως γενομένης προς σκοπόν καταστολής ταραχών ή στάσεως.
