Artikolu 12 - Il-libertà ta' għaqda u ta' assoċjazzjoni

1. Kull persuna għandha d-dritt għal-libertà ta' għaqda paċifika u għal-libertà ta' assoċjazzjoni f'kull livell, b'mod partikolari fil-qasam politiku, tat-trade unions, u ċiviku, li jimplika d-dritt ta' kull persuna li tifforma trade unions flimkien ma' oħrajn u li tissieħeb magħhom għall-protezzjoni ta' l-interessi tagħha.

2. Il-partiti politiċi fil-livell ta' l-Unjoni jikkontribwixxu għall-espressjoni tar-rieda politika taċċittadini ta' l-Unjoni.

  • Text:

    1. Il-paragrafu 1 ta' dan l-Artikolu jikkorrispondi għall-Artikolu 11 tal-KEDB, li jgħid hekk:
    `1. Kulħadd għandu d-dritt għal-libertà ta' għaqda paċifika u għal-libertà ta' assoċjazzjoni ma' oħrajn, inkluż id-dritt li wieħed jifforma u jidħol fi trade unions għall-protezzjoni ta' l-interessi tiegħu.
    2. Ma għandu jkun hemm ebda restrizzjonijiet fuq l-eżerċizzju ta' dawn id-drittijiet ħlief dawk li jkunu preskritti b'liġi u li jkunu meħtieġa f'soċjetà demokratika fl-interessi tas-sigurtà nazzjonali jew tas-sigurtà pubblika, biex jiġi evitat id-diżordni jew l-egħmil ta' delitti, għall-protezzjoni tas-saħħa jew tal-morali jew għall-protezzjoni tad-drittijiet u l-libertajiet ta' ħaddieħor. Dan l-Artikolu ma għandux jimpedixxi l-imposizzjoni ta' restrizzjonijiet skond il-liġi fuq l-eżerċizzju ta' dawn id-drittijiet minn membri tal-Forzi Armati, tal-Pulizija jew ta' l-amministrazzjoni ta' l-Istat`.
    Is-sens tad-dispożizzjonijiet ta' dan l-Artikolu 12(1) hu l-istess bħal dak tal-KEDB, iżda l-ambitu tagħhom hu aktar wiesa' ladarba jistgħu japplikaw fil-livelli kollha inkluż il-livell Ewropew. Skond l-Artikolu 52(3) tal-Karta, il-limitazzjonijiet fuq dak id-dritt ma jistgħux jeċċedu dawk li huma kkunsidrati leġittimi bis-saħħa ta' l-Artikolu 11(2) tal-KEDB.
    2. Dan id-dritt hu bbażat ukoll fuq l-Artikolu 11 tal-Karta Komunitarja dwar id-Drittijiet Soċjali Fundamentali tal-Ħaddiema.
    3. Il-paragrafu 2 ta' dan l-Artikolu jikkorrispondi għall-Artikolu 10(4) tat-Trattat dwar l-Unjoni Ewropea.

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    Dawn l-ispjegazzjonijiet ġew imħejjija oriġinarjament taħt ir-responsabbiltà tal-Praesidium tal-Konvenzjoni li abbozza l-Karta tad-Drittijiet Fundamentali ta' l-Unjoni Ewropea. Huma ġew aġġornati taħt ir-responsabbiltà tal-Praesidium tal-Konvenzjoni Ewropea, fid-dawl ta' l-aġġustamenti li saru għat-test tal-Karta minn dik il-Konvenzjoni (partikolarment fl-Artikoli (51 U 52) u ta' l-evoluzzjoni fil-liġi ta' l-Unjoni. Għalkemm dawn l-ispjegazzjonijiet m'għandhomx fihom infushom l-istatus ta' liġi, huma mezz siewi ta' interpretazzjoni intiż sabiex ikunu ċċarati d-dispożizzjonijiet tal-Karta.

    Article 11

    1. Everyone has the right to freedom of peaceful assembly and to freedom of association with others, including the right to form and to join trade unions for the protection of his interests.

    2. No restrictions shall be placed on the exercise of these rights
    other than such as are prescribed by law and are necessary in a democratic society in the interests of national security or public safety, for the prevention of disorder or crime, for the protection of health or morals or for the protection of the rights and freedoms of others. This Article shall not prevent the imposition of lawful restrictions on the exercise of these rights by members of the armed forces, of the police or of the administration of the State.

    § 1. (Constitutional provision) (1) The existence and diversity of political parties are key elements of the Republic of Austria's democratic order (Art. 1 of the Constitution of Republic of Austria, Federal Law Gazette No. 1/1930). (2) A political party is a permanently organised association which, through common activities, aims at comprehensively influencing the national decisionmaking process, in particular by participating in elections for general representative bodies and the European Parliament, and whose constitution has been deposited with the Federal Ministry of the Interior. (3) Political parties may be freely established, unless the Constitution of Republic of Austria provides otherwise. Their activities shall not be subject to any restrictions by particular legal provisions. (4) The political parties shall resolve on their constitutions, which they shall deposit with the Federal Ministry of the Interior. The political party shall obtain legal personality upon deposit of the constitution. The constitutions shall be published by the political parties on the Internet in an appropriate manner. The constitutions shall, in particular, contain details of 1. the executive bodies or officers of the party and their power of representation, with a manager or managing body, a members’ meeting and a supervisor or supervisory body having to be provided for in any event, 2. the rights and obligations of the members, 3. the structure of the party, 4. provisions on the voluntary dissolution of the political party. (5) Political parties can notify the Federal Ministry of the Interior of their voluntary dissolution. (6) The Court of Audit can, by federal legislation, be delegated the duty 1. to accept statements of accounts of political parties and campaigning parties that are not political parties and the related audit opinions, audit and publish them, appoint auditors for the audit of the statements of accounts and publish the amounts for the support of parties, campaign expenses and donations that were changed due to inflation adjustment, 2. to require legal entities under its supervision to disclose legal transactions with political parties or with undertakings in which a political party or an affiliated organisation or branch of a party that has its own legal personality or a campaigning party that is not a political party holds an interest and to publish such information on its website, 3. to take possession of donations that political parties or campaigning parties that are not political parties or members of parliament or candidates who stood for elections on a list of candidates submitted by a political party received improperly, keep them in safe custody, list them in the report on its activities and forward them to institutions serving charitable or scientific purposes, and 4. to submit the documents to the competent authority in the event of suspected violations by political parties or campaigning parties that are not political parties or affiliated organisations or branches of a party with their own legal personality or of suspected violations by a member of parliament or candidate who stood for elections on a list of candidates submitted by a political party of accountability obligations or prohibitionsagainst the acceptance of donations or restrictions on campaign expenses.

  • Konvention zum Schutze der Menschenrechte und Grundfreiheiten

    Artikel 11 (1) Alle Menschen haben das Recht, sich friedlich zu versammeln und sich frei mit anderen zusammenzuschließen, einschließlich des Rechts, zum Schutze ihrer Interessen Gewerkschaften zu bilden und diesen beizutreten. (2) Die Ausübung dieser Rechte darf keinen anderen Einschränkungen unterworfen werden als den vom Gesetz vorgesehenen, die in einer demokratischen Gesellschaft im Interesse der nationalen und öffentlichen Sicherheit, der Aufrechterhaltung der Ordnung und der Verbrechensverhütung, des Schutzes der Gesundheit und der Moral oder des Schutzes der Rechte und Freiheiten anderer notwendig sind. Dieser Artikel verbietet nicht, daß die Ausübung dieser Rechte durch Mitglieder der Streitkräfte, der Polizei oder der Staatsverwaltung gesetzlichen Einschränkungen unterworfen wird.
