Člen 21 - Prepoved diskriminacije

1. Prepovedana je vsakršna diskriminacija na podlagi spola, rase, barve kože, etničnega ali socialnega porekla, genetskih značilnosti, jezika, vere ali prepričanja, političnega ali drugega mnenja, pripadnosti narodnostni manjšini, premoženja, rojstva, invalidnosti, starosti ali spolne usmerjenosti.
2. Brez poseganja v posebne določbe Pogodb je na njunem področju uporabe prepovedana vsakršna diskriminacija na podlagi državljanstva.

    Odstavek 1 izhaja iz člena 13 Pogodbe ES, ki ga je sedaj nadomestil člen 19 Pogodbe o delovanju Evropske unije, iz 14. člena EKČP in – glede genetske dediščine – iz 11. člena Konvencije o človekovih pravicah v zvezi z biomedicino. Če ustreza 14. členu EKČP, se uporablja v skladu s slednjim.
    Med odstavkom 1 in členom 19 Pogodbe o delovanju Evropske unije ni neskladja ali nezdružljivosti, saj ima slednji drugo področje uporabe in namen: člen 19 Uniji dodeljuje pristojnost, da sprejema zakonodajne akte, vključno z usklajevanjem zakonov in drugih predpisov držav članic za boj proti nekaterim oblikam diskriminacije, ki so izčrpno naštete v tem členu. Taka zakonodaja lahko vključuje dejavnosti organov držav članic (kot tudi odnose med posamezniki) na vseh področjih v okviru pristojnosti Unije. V nasprotju s tem pa določbe člena 21(1) ne določajo nobenih pooblastil za sprejemanje protidiskriminacijskih zakonov na teh področjih delovanja držav članic ali posameznikov, niti ne določajo splošne prepovedi diskriminacije na teh področjih. Namesto tega se nanašajo zgolj na diskriminacijo s strani samih institucij in teles Unije pri izvajanju pristojnosti, dodeljenih po pogodbah, in s strani držav članic pri izvajanju zakonodaje Unije. Odstavek 1 torej ne spreminja niti obsega pristojnosti iz člena 19 niti razlage tega člena.
    Odstavek 2 ustreza členu 18(1) Pogodbe o delovanju Evropske unije in ga je treba uporabljati ob upoštevanju tega člena.

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    V nadaljevanju navedena pojasnila so bila prvotno pripravljena pod vodstvom predsedstva Konvencije, ki je sestavilo Listino Evropske unije o temeljnih pravicah. Ta pojasnila so bila posodobljena pod vodstvom predsedstva Evropske konvencije zaradi prilagoditve besedila Listine s strani omenjene konvencije (zlasti členov 51 in 52) in nadaljnjega razvoja prava Unije. Čeprav sama nimajo pravne veljave, so dragocena pomoč pri razlagi in pojasnjevanju določb Listine.

    Section 13 Direct discrimination
    (1) A person (A) discriminates against another (B) if, because of a protected characteristic, A treats B less favourably than A treats or would treat others.
    (2) If the protected characteristic is age, A does not discriminate against B if A can show A's treatment of B to be a proportionate means of achieving a legitimate aim.
    (3) If the protected characteristic is disability, and B is not a disabled person, A does not discriminate against B only because A treats or would treat disabled persons more favourably than A treats B.
    (4)If the protected characteristic is marriage and civil partnership, this section applies to a contravention of Part 5 (work) only if the treatment is because it is B who is married or a civil partner.
    (5) If the protected characteristic is race, less favourable treatment includes segregating B from others.
    (6) If the protected characteristic is sex—
    (a) less favourable treatment of a woman includes less favourable treatment of her because she is breast-feeding;
    (b) in a case where B is a man, no account is to be taken of special treatment afforded to a woman in connection with pregnancy or childbirth.
    (7) Subsection (6)(a) does not apply for the purposes of Part 5 (work).
    (8) This section is subject to sections 17(6) and 18(7).

    Section 19 Indirect discrimination
    (1)A person (A) discriminates against another (B) if A applies to B a provision, criterion or practice which is discriminatory in relation to a relevant protected characteristic of B's.
    (2) For the purposes of subsection (1), a provision, criterion or practice is discriminatory in relation to a relevant protected characteristic of B's if—
    (a) A applies, or would apply, it to persons with whom B does not share the characteristic,
    (b) it puts, or would put, persons with whom B shares the characteristic at a particular disadvantage when compared with persons with whom B does not share it,
    (c) it puts, or would put, B at that disadvantage, and
    (d) A cannot show it to be a proportionate means of achieving a legitimate aim.
    (3) The relevant protected characteristics are—
    age;
    disability;
    gender reassignment;
    marriage and civil partnership;
    race;
    religion or belief;
    sex;
    sexual orientation.

    Definitions

    (25) ‘people with fewer opportunities’ means people who, for economic, social, cultural, geographical or health reasons, due to their migrant background, or for reasons such as disability or educational difficulties or for any other reason, including a reason that could give rise to discrimination under Article 21 of the Charter of Fundamental Rights of the European Union, face obstacles that prevent them from having effective access to opportunities under the Programme;

    (31) Consumers who are legally resident in the Union should not be discriminated against on the ground of their nationality or place of residence, or on any ground as referred to in Article 21 of the Charter when requesting, concluding or holding a credit agreement within the Union. This is without prejudice to the possibility of offering different conditions of access to a credit where those different conditions are duly justified by objective criteria. Moreover, this should not be understood as creating an obligation for creditors or credit intermediaries to provide services in areas in which they do not conduct business.

    Article 6

    Non-discrimination

    Member States shall ensure that the conditions to be fulfilled for being granted a credit do not discriminate against consumers legally resident in the Union on ground of their nationality or place of residence or on any ground as referred to in Article 21 of the Charter of Fundamental Rights of the European Union, when those consumers request, conclude or hold a credit agreement within the Union.

    Article 1

    Subject matter and scope

    1. This Regulation lays down uniform rules to address the misuse of hosting services for the dissemination to the public of terrorist content online, in particular on:

    (a) reasonable and proportionate duties of care to be applied by hosting service providers in order to address the dissemination to the public of terrorist content through their services and ensure, where necessary, the expeditious removal of or disabling of access to such content;

    (b) the measures to be put in place by Member States, in accordance with Union law and subject to suitable safeguards to protect fundamental rights, in particular the freedom of expression and information in an open and democratic society, in order to:

    (i) identify and ensure the expeditious removal of terrorist content by hosting service providers; and

    (ii) facilitate cooperation among the competent authorities of Member States, hosting service providers and, where appropriate, Europol.

    2. This Regulation applies to hosting service providers offering services in the Union, irrespective of their place of main establishment, insofar as they disseminate information to the public.

    3. Material disseminated to the public for educational, journalistic, artistic or research purposes or for the purposes of preventing or countering terrorism, including material which represents an expression of polemic or controversial views in the course of public debate, shall not be considered to be terrorist content. An assessment shall determine the true purpose of that dissemination and whether material is disseminated to the public for those purposes.

    4. This Regulation shall not have the effect of modifying the obligation to respect the rights, freedoms and principles referred to in Article 6 TEU and shall apply without prejudice to fundamental principles relating to freedom of expression and information, including freedom and pluralism of the media.

    5. This Regulation shall be without prejudice to Directives 2000/31/EC and 2010/13/EU. For audiovisual media services as defined in point (a) of Article 1(1) of Directive 2010/13/EU, Directive 2010/13/EU shall prevail.

    Article 34

    Risk assessment

    1. Providers of very large online platforms and of very large online search engines shall diligently identify, analyse and assess any systemic risks in the Union stemming from the design or functioning of their service and its related systems, including algorithmic systems, or from the use made of their services.

    They shall carry out the risk assessments by the date of application referred to in Article 33(6), second subparagraph, and at least once every year thereafter, and in any event prior to deploying functionalities that are likely to have a critical impact on the risks identified pursuant to this Article. This risk assessment shall be specific to their services and proportionate to the systemic risks, taking into consideration their severity and probability, and shall include the following systemic risks:

    (b) any actual or foreseeable negative effects for the exercise of fundamental rights, in particular the fundamental rights to human dignity enshrined in Article 1 of the Charter, to respect for private and family life enshrined in Article 7 of the Charter, to the protection of personal data enshrined in Article 8 of the Charter, to freedom of expression and information, including the freedom and pluralism of the media, enshrined in Article 11 of the Charter, to non-discrimination enshrined in Article 21 of the Charter, to respect for the rights of the child enshrined in Article 24 of the Charter and to a high-level of consumer protection enshrined in Article 38 of the Charter;

    Subject matter

    ‘24. Article 5 of the Convention enshrines the obligation of States parties to prohibit and eliminate racial discrimination and to guarantee the right of everyone, without distinction as to race, colour, or national or ethnic origin, to equality before the law, notably in the enjoyment of civil, political, economic, social and cultural rights, including the rights to freedom of thought, conscience and religion, freedom of opinion and expression, and freedom of peaceful assembly and association.‘

The Committee considers that the expression of ideas and opinions made in the context of academic debates, political engagement or similar activity, and without incitement to hatred, contempt, violence or discrimination, should be regarded as legitimate exercises of the right to freedom of expression, even when such ideas are controversial.‘

In addition to its inclusion in article 5, freedom of opinion and expression is recognized as a fundamental right in a broad range of international instruments, including the Universal Declaration of Human Rights, which affirm that everyone has the right to hold opinions and to seek, receive and impart information and ideas of all kinds through any media and regardless of frontiers. The right to freedom of expression is not unlimited but carries with it special duties and responsibilities. It may therefore be subject to certain restrictions, but only if they are provided by law and are necessary for protection of the rights or reputations of others and for the protection of national security or of public order, or of public health or morals. Freedom of expression should not aim at the destruction of the rights and freedoms of others, including the right to equality and non-discrimination.‘
