In view of the increasing numbers of refugees, asylum seekers and migrants entering the EU, the European Commission asked FRA to collect data about the fundamental rights situation of people arriving in those Member States that have been particularly affected by large migration movements. Scope of the principle of non-refoulement in contemporary border management: evolving areas of law
EU Member States are increasingly involved in border management activities on the high seas, within – or i cooperation with – third countries, and at the EU’s borders. Such activities entail risks of violating the principle of non-refoulement, the cornerstone of the international legal regime for the protection of refugees, which prohibits returning individuals to a risk of persecution. This report aims to encourage fundamental-rights compliant approaches to border management, including by highlighting potential grey areas.

Leitlinien zur Verringerung des Risikos der Zurückweisung im Rahmen des Außengrenzen-Managements in oder in Zusammenarbeit mit Drittländern
Die EU-Mitgliedstaaten beteiligen sich immer häufiger an Maßnahmen des Grenzmanagements auf hoher See, die in oder in Zusammenarbeit mit Drittländern und an den EU Grenzen stattfinden. Derartige Maßnahmen bergen die Gefahr, gegen den Grundsatz der Nichtzurückweisung zu verstoßen. Dieser Eckpfeiler des internationalen Rechtsrahmens für den Schutz von Flüchtlingen verbietet die Rückführung von Personen in ein Land, in dem ihnen Verfolgung droht. Die vorliegenden Leitlinien enthalten konkrete Vorschläge, wie das Risiko der Zurückweisung in solchen Situationen verringert werden kann – ein praktisches Instrument, das unter Mitwirkung von ExpertInnen anlässlich eines Treffens in Wien im März 2016 entwickelt wurde.

This guidance outlines specific suggestions on how to reduce the risk of refoulement in these situations – a practical tool developed with the input of experts during a meeting held in Vienna in March of 2016.

Orientations sur les moyens de réduire le risque de refoulement dans la gestion des frontières extérieures en cas d’activité professionnelle dans des pays tiers ou de coopération avec ceux-ci
Les États membres de l’UE participent de plus en plus à des activités de gestion des frontières en haute mer, sur le territoire de pays tiers, ou en coopération avec ces derniers, ainsi qu’aux frontières de l’UE. Ces activités peuvent comporter des risques de violation du principe de non-refoulement, la pierre angulaire du régime international juridique assurant la protection des réfugiés, qui interdit le retour d’individus vers une situation de risque de persécution. Ces orientations présentent des suggestions spécifiques sur les moyens de réduire les risques de refoulement dans ces situations. Elles constituent un outil pratique élaboré à l’aide de contributions d’experts réunis à Vienne en mars 2016.

80 % от респондентите роми живеят под прага на бедността за тяхната страна. Всеки трети ром живее в жилище без течаща вода. Всяко трето ромско дете живее в домакинство, в което някой си е легнал гладен поне веднъж през предходния месец. Ромските деца изостават от своите неромски връстници по всички показатели за образование. Тези — и други — констатации в настоящия доклад открояват тревожна действителност, пред която не можем да си затваряме очите: най-голямото етническо малцинство в Европейския съюз продължава да се сблъсква с дискриминация и неравен достъп до различни жизненоважни услуги.

Druhé šetření o menšinách a diskriminaci v Evropské unii – Romové – vybrané výsledky
V této zprávě se hovoří o tom, že 80 % dotazovaných Romů žije pod hranicí ohrožení chudobou platnou v dané zemi, každý třetí Rom žije v obydlí bez tekoucí vody, každé třetí romské dítě žije v domácnosti, kde nejméně jednou za poslední měsíc někdo musel jít spát hladový, a že romské děti zaostávají za svými neromskými spolužáky ve vzdělanosti; tato zpráva tak zdůrazňuje zneklidňující, nicméně nevyhnutelný fakt: nejpočetnější etnická menšina v Evropské unii nadále čelí diskriminaci a nerovnému přístupu k některým životně důležitým službám.

Den Europæiske Unions anden undersøgelse af mindretal og forskelsbehandling – Romaer – udvalgte resultater
På baggrund af at 80 % af romaerne i undersøgelsen lever under deres lands fattigdomsrisikotærskel, at hver tredje roma bor i en bolig uden ledningsvand, at hvert tredje romabarn bor i en husstand, hvor nogen er gået sulten i seng mindst én gang i den foregående måned, og at romabørn halter bagefter ikkeromabørn inden for uddannelse, understreger denne rapport en foruroligende, men uundgåelig realitet, nemlig at Den Europæiske Unions største etniske mindretal fortsat oplever en uacceptabel forskelsbehandling og ulige adgang til livsvigtige tjenester.
