From 2015 to 2023, FRA regularly published bulletins on fundamental rights issues related to migration and asylum. As part of the EU's 2024 Asylum and Migration Management Regulation, FRA is now restarting this reporting ahead of the June 2026 implementation of the EU Migration and Asylum Pact. This first bulletin in the new series takes stock of the situation of migrants, asylum seekers and refugees as of March 2026. It looks at key developments between January 2025 and the end of March 2026, as well as ongoing problems and new areas of concern.

This note draws attention to the recent trend of criminalising search and rescue operations (SAR) in the Mediterranean Sea carried out by non-governmental organisations (NGOs) or other private entities. This includes seizing rescue vessels, as well as arrests for crew members, in some EU Member States. Most of such incidents concerned NGOs operating in the Central Mediterranean Sea.

This FRA report examines the conditions at Europe’s southern sea borders with respect to the most fundamental rights of a person, the right to life and the right not to be sent back to torture, persecution or inhuman treatment. It looks at sea border surveillance and disembarkation procedures, as well as general issues such as European Union (EU) policy, training and Frontex-coordinated operations, and examines practices across the EU Member States researched – Cyprus, Greece, Italy, Malta and Spain.
