Članak 49 - Načela zakonitosti i proporcionalnosti kaznenih djela i kazni

1. Nitko ne smije biti osuñen zbog bilo kojeg kaznenog djela ili propusta koji, u trenutku počinjenja, nije bio kazneno djelo u skladu s nacionalnim i meñunarodnim pravom. Ne smije mu biti izrečena ni stroža kazna od one koja je bila primjenjiva u trenutku počinjenja kaznenog djela. Ako je, nakon počinjenja kaznenog djela, pravom propisana blaža kazna, primjenjuje se takva kazna.
2. Ovaj članak ne dovodi u pitanje suñenje i kažnjavanje bilo koje osobe zbog bilo kojeg djela ili propusta koji su, u trenutku počinjenja, smatrani kaznenim djelom u skladu s općim načelima koja priznaju svi narodi.
3. Strogost kazne ne smije biti nerazmjerna kaznenom djelu.

    2. This Article shall not prejudice the trial and punishment of any person for any act or omission which, at the time when it was committed, was criminal according to the general principles of law recognised by civilised nations.

    Artikel 7 (1) Niemand kann wegen einer Handlung oder Unterlassung verurteilt werden, die zur Zeit ihrer Begehung nach inländischem oder internationalem Recht nicht strafbar war. Ebenso darf keine höhere Strafe als die im Zeitpunkt der Begehung der strafbaren Handlung angedrohte Strafe verhängt werden. (2) Durch diesen Artikel darf die Verurteilung oder Bestrafung einer Person nicht ausgeschlossen werden, die sich einer Handlung oder Unterlassung schuldig gemacht hat, welche im Zeitpunkt ihrer Begehung nach den von den zivilisierten Völkern allgemein anerkannten Rechtsgrundsätzen strafbar war.
