Article 41 - Droit à une bonne administration

1. Toute personne a le droit de voir ses affaires traitées impartialement, équitablement et dans un délai raisonnable par les institutions, organes et organismes de l'Union. 2. Ce droit comporte notamment: a) le droit de toute personne d'être entendue avant qu'une mesure individuelle qui l'affecterait défavorablement ne soit prise à son encontre; b) le droit d'accès de toute personne au dossier qui la concerne, dans le respect des intérêts légitimes de la confidentialité et du secret professionnel et des affaires; c) l'obligation pour l'administration de motiver ses décisions. 3. Toute personne a droit à la réparation par l'Union des dommages causés par les institutions, ou par ses agents dans l'exercice de leurs fonctions, conformément aux principes généraux communs aux droits des États membres. 4. Toute personne peut s'adresser aux institutions de l'Union dans une des langues des traités et doit recevoir une réponse dans la même langue.

    L'article 41 est fondé sur l'existence de l'Union en tant que communauté de droit dont les caractéristiques ont été développées par la jurisprudence, qui a consacré notamment la bonne administration comme principe général de droit (voir, entre autres, l'arrêt de la Cour du 31 mars 1992, C-255/90 P, Burban, rec. 1992, p. I-2253, ainsi que les arrêts du Tribunal de première instance du 18 septembre 1995, T-167/94, Nölle, rec. 1995, p. II-2589; du 9 juillet 1999, T-231/97, New Europe Consulting e.a., rec. 1999, p. II-2403). Les expressions de ce droit énoncées dans les deux premiers paragraphes résultent de la jurisprudence (arrêts de la Cour du 15 octobre 1987, aff. 222/86, Heylens, rec. 1987, p. 4097, point 15; du 18 octobre 1989, aff. 374/87, Orkem, rec. 1989, p. 3283; du 21 novembre 1991, C-269/90, TU München, rec. 1991, p. I-5469) ainsi que les arrêts du Tribunal de première instance du 6 décembre 1994, T-450/93, Lisrestal, rec. 1994, II-1177; du 18 septembre 1995, T-167/94, Nölle, rec. 1995, p. II-2589) et, en ce qui concerne l'obligation de motivation, de l'article 296 du traité sur le fonctionnement de l'Union européenne (voir aussi la base juridique à l'article 298 du traité sur le fonctionnement de l'Union européenne pour l'adoption d'actes législatifs en vue d'une administration européenne ouverte, efficace et indépendante).

    Le paragraphe 3 reproduit le droit désormais garanti à l'article 340 du traité sur le fonctionnement de l'Union européenne. Le paragraphe 4 reproduit le droit désormais garanti à l'article 20, paragraphe 2, point d), et à l'article 25 du traité sur le fonctionnement de l'Union européenne. Conformément à l'article 52, paragraphe 2, ces droits s'appliquent dans les conditions et limites définies dans les traités.

    Le droit à un recours effectif, qui constitue un aspect important de cette question, est garanti à l'article 47 de la présente Charte.

    Les explications qui figurent ci-après ont été établies initialement sous la responsabilité du praesidium de la Convention qui a élaboré la Charte des droits fondamentaux de l'Union européenne. Elles ont été mises à jour sous la responsabilité du praesidium de la Convention européenne, compte tenu des adaptations apportées au texte de la Charte par ladite Convention (notamment aux articles 51 et 52) et de l'évolution du droit de l'Union. Bien que ces explications n'aient pas en soi de valeur juridique, elles constituent un outil d'interprétation précieux destiné à éclairer les dispositions de la Charte.

    Article 26 - Right to Compensation Everyone has the right to compensation for damage caused through unlawful actions in connection with the performance of any function or other activity by a person or body performing such function or activity under state authority, local community authority or as a bearer of public authority.Any person suffering damage has the right to demand, in accordance with the law, compensation also directly from the person or body that has caused damage.

    Article 39 - Freedom of Expression Freedom of expression of thought, freedom of speech and public appearance, of the press and other forms of public communication and expression shall be guaranteed. Everyone may freely collect, receive and disseminate information and opinions.Except in such cases as are provided by law, everyone has the right to obtain information of a public nature in which he has a well founded legal interest under law.

    Article 40 - Right to Correction and Reply The right to correct published information which has damaged a right or interest of an individual, organisation or body shall be guaranteed, as shall be the right to reply to such published information.

Every person has the right individually or jointly with others to address written requests or complaints to any competent public authority and to have them attended to and decided expeditiously; an immediate notice of any such decision taken duly reasoned shall be given to the person making the request or complaint and in any event within a period not exceeding thirty days.

Η απόφασις της αρχής ταύτης, δεόντως ητιολογημένη, γνωστοποιείται εγγράφως αμέσως εις τον υποβαλόντα την αίτησιν ή τα παράπονα εν πάση περιπτώσει ενός προθεσμίας μη υπερβαινούσης τας τριάκοντα ημέρας.
    2. Εφ’ όσον ο ενδιαφερόμενος δεν ικανοποιείται εκ της αποφάσεως ή οσάκις ουδεμία απόφασις γνωστοποιήται προς αυτόν εντός της καθοριζομένης εν τη πρώτη παραγράφω του παρόντος άρθρου προθεσμίας δύναται ο ενδιαφερόμενος ν’ αγάγη ενώπιον αρμοδίου δικαστηρίου διά προσφυγής την υπόθεσιν, εις ην αφορά η αίτησις ή το παράπονον αυτού.

    – pravo podnošenja peticija Europskom parlamentu, predstavki Europskom ombudsmanu te pravo obraćanja institucijama i savjetodavnim tijelima Europske unije na hrvatskom jeziku, kao i na svim službenim jezicima Europske unije, te pravo dobiti odgovor na istom jeziku.
    Sva prava ostvaruju se u skladu s uvjetima i ograničenjima propisanima ugovorima na kojima se temelji Europska unija te mjerama prihvaćenima na temelju tih ugovora.
    U Republici Hrvatskoj sva prava zajamčena pravnom stečevinom Europske unije uživaju svi građani Europske unije.

    Article 1 - Objectives and tasks
    ‘1. In order to step up the fight against fraud, corruption and any other illegal activity affecting the financial interests of the European Union and of the European Atomic Energy Community (hereinafter referred to collectively, when the context so requires, as ‘the Union’), the European Anti-Fraud Office established by Decision 1999/352/EC, ECSC, Euratom (‘the Office’) shall exercise the powers of investigation conferred on the Commission by:
    (a) the relevant Union acts; and
    (b) the relevant cooperation and mutual assistance agreements concluded by the Union with third countries and international organisations. [...]‘
