    `Nenhuma das disposições da presente Convenção se pode interpretar no sentido de implicar para um Estado, grupo ou indivíduo qualquer direito de se dedicar a actividade ou praticar actos em ordem à destruição dos direitos ou liberdades reconhecidos na presente Convenção ou a maiores limitações de tais direitos e liberdades do que as previstas na Convenção.`

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    As presentes anotações, inicialmente elaboradas sob a responsabilidade do Praesidium da Convenção que redigiu a Carta dos Direitos Fundamentais da União Europeia, foram actualizadas sob a responsabilidade do Praesidium da Convenção Europeia, à luz das adaptações ao texto (nomeadamente aos artigos 51.o e 52.o) da Carta introduzidas pela Convenção Europeia e da evolução do direito da União. Embora não tenham em si força de lei, constituem um valioso instrumento de interpretação destinado a clarificar as disposições da Carta.

While exercising border control, states have a duty to protect the fundamental rights of all people under their jurisdiction, regardless of their nationality and/or legal status.     Today, a single camera scan from a distance can identify one person in a crowd. Law enforcement authorities in a growing number of EU Member States use or are considering using this AI-driven technique, known as remote biometric identification. While it can support public security and protect people from crime, it also poses serious risks to fundamental rights. FRA’s report draws on legal analysis, interviews with law enforcement practitioners and other experts, observations of police work and a public survey across selected EU Member States. FRA points to the need for a comprehensive legal basis for RBI use for law enforcement, including defined purposes, limits on identifying participants in peaceful assemblies or political gatherings, independent oversight and fundamental rights impact assessments, all of which should be in place before RBI is deployed.

    The Roma Survey 2024 and its predecessors describe discrimination and bias-motivated harassment and violence experienced by Roma and Travellers across Europe.     The EU Agency for Fundamental Rights regularly collects data on the operations of NGO vessels involved in search and rescue in the Mediterranean. This includes any legal proceedings against them, as well as any difficulties in disembarking migrants in safe ports. This paper provides an overview of criminal investigations and other legal proceedings initiated by European Union Member States against civil society organisations deploying search and rescue vessels and aircraft in the Mediterranean and/or against crew members. The latest update covers the period from 2018 up until 30 June 2026.
