Zehn Jahre danach: Das volle Potential der Charta ausschöpfen. Fokus
In diesem Fokus wird die Anwendung der Charta der Grundrechte
der Europäischen Union, die seit zehn Jahren rechtsverbindlich
ist, näher beleuchtet. Auf EU-Ebene hat sie an Außenwirkung
gewonnen und Impulse für eine neue Grundrechtekultur
gesetzt. Auf nationaler Ebene sind der Bekanntheitsgrad und die
Anwendung der Charta begrenzt. Die Gerichte nutzen die Charta in
zunehmendem Maße, was deutlich macht, welche Wirkung dieses
moderne Instrument besitzt. Von Regierungen und Parlamenten
wird sie jedoch kaum genutzt. So gibt es beispielsweise nur wenige
Anhaltspunkte dafür, dass die einzelstaatlichen Rechtsvorschriften,
mit denen EU-Recht umgesetzt wird, regelmäßig daraufhin
überprüft werden, ob sie mit der Charta im Einklang stehen.

Ten years on: unlocking the Charter’s full potential
This focus takes a closer look at the application of the Charter of Fundamental Rights of the European Union, which has been legally binding for 10 years. At EU level, it has gained visibility and sparked a new fundamental rights culture. At national level, awareness and use of the Charter are limited. Courts increasingly use the Charter, showing the impact of this modern instrument. But its use by governments and parliaments remains low. For instance, there is little indication of anyone regularly scrutinising national legislation that transposes EU law for compatibility with the Charter.

La Charte dix ans après : comment libérer pleinement son potentiel?
Le présent Focus examine dans le détail l’application de la Charte des droits fondamentaux de l’Union européenne, qui est juridiquement contraignante depuis dix ans. Au niveau de l’Union européenne (UE), la Charte a gagné en visibilité et a été le moteur d’une nouvelle culture des droits fondamentaux. Au niveau national, la connaissance et l’utilisation de la Charte sont limitées. Les instances judiciaires ont de plus en plus recours à la Charte, ce qui démontre l’importance de cet instrument moderne. Cependant, son utilisation par les gouvernements et les parlements reste faible. Par exemple, rien n’indique qu’une quelconque autorité soit chargée de contrôler régulièrement la législation nationale transposant le droit de l’UE afin de s’assurer de sa compatibilité avec la Charte.

Dziesięć lat później: uwolnienie pełnego potencjału Karty
W niniejszym dokumencie zwraca się szczególną uwagę
na stosowanie Karty praw podstawowych Unii Europejskiej,
która jest prawnie wiążąca od 10 lat. Na szczeblu unijnym
stała się ona bardziej widoczna i zapoczątkowała nową
kulturę praw podstawowych. Na szczeblu krajowym
świadomość i stosowanie Karty są ograniczone. Sądy w coraz
większym stopniu stosują Kartę, co pokazuje znaczenie tego
nowoczesnego instrumentu. Niemniej jednak jego stosowanie
przez rządy i parlamenty pozostaje na niskim poziomie.
Przykładowo niewiele wskazuje na to, by ktokolwiek
regularnie kontrolował przepisy krajowe dokonujące
transpozycji prawa Unii pod kątem ich zgodności z Kartą.

Dez anos depois: libertar todo o potencial da Carta dos Direitos Fundamentais
O presente Destaque aborda mais de perto a aplicação da
Carta dos Direitos Fundamentais da União Europeia, que se
tornou juridicamente vinculativa há 10 anos. Ao nível da UE,
a Carta ganhou visibilidade e deu origem a uma nova cultura
de direitos fundamentais. No plano nacional, a sensibilização
para a Carta e a sua utilização têm sido limitadas. Os tribunais
utilizam cada vez mais a Carta, evidenciando o impacto deste
moderno instrumento. Mas a sua utilização pelos governos
e parlamentos continua a ser modesta. Por exemplo, há
poucas indicações sobre a existência ou não de pessoas
que se dedicam a examinar regularmente se as legislações
nacionais que transpõem a legislação da UE são compatíveis
com a Carta.

Deset let po sprejetju: izkoriščanje vseh možnosti Listine
Ta osrednja tema podrobneje obravnava uporabo Listine
Evropske unije o temeljnih pravicah, ki je pravno zavezujoča
že 10 let. Na ravni EU je postala prepoznavnejša, spodbudila
pa je tudi novo kulturo spoštovanja temeljnih pravic. Na
nacionalni ravni sta uporaba Listine in ozaveščenost o njej
omejeni. Na sodiščih se uporaba tega sodobnega instrumenta
povečuje, kar kaže, da ima vpliv, vlade in parlamenti pa ga
še naprej uporabljajo le redko. Tako na primer skoraj nič ne
kaže na to, da kdo redno podrobno preverja, ali je nacionalna
zakonodaja za prenos prava EU skladna z Listino.

Verslag over de grondrechten 2020 — FRA-adviezen
Het jaar 2019 kende zowel vooruitgang als
teleurstellingen bij de bescherming van grondrechten.
In het Verslag over de grondrechten 2020 van het FRA
worden de belangrijkste ontwikkelingen op het gebied
van de grondrechten geëvalueerd en wordt niet alleen
ingegaan op de behaalde successen, maar ook
gewezen op blijvende punten van zorg. Deze publicatie
laat de FRA-adviezen over de belangrijkste
ontwikkelingen op de besproken thematische
gebieden de revue passeren en geeft een
samenvatting van de feitelijke gegevens waarop deze
adviezen berusten. Het resultaat is een beknopt, maar
informatief overzicht van de belangrijkste uitdagingen

Z hľadiska ochrany základných práv rok 2019 priniesol
pokrok i určité nezdary. V publikácii agentúry FRA
Správa o základných právach 2020 je uvedený prehľad
hlavného vývoja v tejto oblasti, poukazuje sa
na úspechy, ale aj na oblasti, ktoré ešte stále
vyvolávajú obavy. V tejto publikácii sú uvedené
stanoviská agentúry FRA k hlavnému vývoju
v uvedených tematických oblastiach, ako aj súhrn
dôkazov podporujúcich tieto stanoviská. Uvádza sa
zároveň aj ucelený a informatívny prehľad o hlavných

Poročilo o temeljnih pravicah 2020 – mnenja agencije FRA
Leta 2019 je bil na področju varstva temeljnih pravic
dosežen napredek, opazno pa je bilo tudi nazadovanje.
Poročilo agencije FRA o temeljnih pravicah 2020
zajema pregled razvoja glavnih dogodkov na tem
področju ter opredeljuje dosežke in področja, ki so še
vedno zaskrbljujoča. Predstavlja mnenja agencije FRA
o glavnih dogodkih na tematskih področjih, ki jih
zajema, in povzema dokaze za ta mnenja. Pri tem
zagotavlja jedrnat, vendar informativen pregled
glavnih izzivov na področju temeljnih pravic, s katerimi
se spopadajo EU in njene države članice.

Rapport om grundläggande rättigheter 2020 – FRA:s yttranden
År 2019 innebar både framgångar och motgångar för
skyddet av de grundläggande rättigheterna. FRA:s
Rapport om grundläggande rättigheter 2020 innehåller
en granskning av de viktigaste händelserna på
området och pekar ut både framsteg och återstående
problemområden. I publikationen presenteras FRA:s
yttranden om den huvudsakliga utvecklingen på de
berörda tematiska områdena, tillsammans med en
översikt över bakgrunden till dessa yttranden. Det ger
en kortfattad men informativ översikt över de
viktigaste utmaningarna för EU och dess
medlemsstater när det gäller grundläggande
rättigheter.

Доклад относно основните права — 2020 г. Становища на FRA
През 2019 г. отбелязахме както напредък, така и неуспехи по отношение на защитата на основните права. В Доклада на FRA относно основните права от 2020 г. е извършен преглед на важните развития в областта, като са посочени както постиженията, така и областите, които все още пораждат загриженост. В настоящата публикация са представени становищата на FRA относно основните развития в обхванатите тематични области и обзор на доказателствата в подкрепа на тези становища. По този начин в нея е даден стегнат, но съдържателен преглед на основните предизвикателства в областта на основните права, пред които са изправени ЕС и неговите държави членки.

Zpráva o základních právech 2020 – stanoviska agentury FRA
Rok 2019 přinesl v oblasti ochrany základních práv
pokrok i nezdary. Zpráva o základních právech 2020
agentury FRA přináší přehled hlavního vývoje v této
oblasti a upozorňuje jak na úspěchy, tak na oblasti,
které i nadále vzbuzují obavy. Tato publikace
představuje stanoviska agentury FRA k hlavnímu
vývoji v uvedených tematických oblastech a souhrn
důkazů podporujících tato stanoviska. Poskytuje tak
hutný, ale informativní přehled hlavních problémů,
jimž EU a její členské státy čelí v oblasti základních
práv.
