Fallstudien zur Charta - Handbuch für Ausbilder
Die Charta der Grundrechte der Europäischen Union (im Folgenden „Charta“) ist der Grundrechtekatalog der EU. Die Organe und Einrichtungen sowie die Mitgliedstaaten der EU sind immer dann an die Charta gebunden, wenn sie im Rahmen des EU-Rechts handeln. Es ist jedoch alles andere als einfach zu beurteilen, ob ein konkreter Fall in den Anwendungsbereich des EU-Rechts fällt. Aus diesem Grund ist es wichtig, dass Angehörigen der Rechtsberufe Schulungen und Schulungsmaterial zur Verfügung stehen, damit sie den in Artikel 51 der Charta festgelegten Anwendungsbereich verstehen können. Das vorliegende Handbuch für Ausbilder soll als Anleitung für die Organisation und Durchführung solcher Schulungen auf der Grundlage einer Reihe von Fallstudien dienen, die in Zukunft erweitert werden.

Ο Χάρτης των Θεμελιωδών Δικαιωμάτων της Ευρωπαϊκής Ένωσης («ο Χάρτης») συνιστά τη διακήρυξη δικαιωμάτων της ΕΕ. Λειτουργεί πάντα δεσμευτικά για τα θεσμικά όργανα της ΕΕ καθώς και τα κράτη μέλη, όταν αυτά δρουν εντός του πεδίου εφαρμογής του δικαίου της Ένωσης. Ωστόσο, η εκτίμηση του εάν μια συγκεκριμένη υπόθεση εμπίπτει στο πεδίο εφαρμογής του δικαίου της Ένωσης παρουσιάζει δυσκολίες. Για αυτόν τον λόγο είναι απαραίτητη η κατάρτιση των ασκούντων νομικά επαγγέλματα και η παροχή σε αυτούς εκπαιδευτικού υλικού, ώστε να είναι σε θέση να κατανοούν το πεδίο εφαρμογής του Χάρτη όπως ορίζεται στο άρθρο 51 αυτού. Το παρόν εγχειρίδιο εκπαιδευτή έχει ως στόχο να παρέχει καθοδήγηση τόσο σε επίπεδο οργάνωσης όσο και σε επίπεδο υλοποίησης των εν λόγω προγραμμάτων κατάρτισης με βάση μια σειρά από μελέτες περίπτωσης, οι οποίες θα εμπλουτιστούν μελλοντικά.

The Charter of Fundamental Rights of the European Union (CFREU) is the EU’s bill of rights. It always binds the EU institutions and the Member States when they act within the scope of EU law. However, it is far from easy to assess whether a concrete case falls within the scope of EU law. This is why it is necessary to provide training and training material to legal professionals so that they can understand the field of application of the Charter as laid out in its Article 51. This trainer’s manual aims at providing guidance on both the organisation and the implementation of such trainings based on a series of case studies,
which will be extended in the future.

La Charte des droits fondamentaux de l’Union européenne (ci-après la «CDFUE » ou la « Charte ») est le cadre supranational qui consacre les droits fondamentaux des personnes dans l'Union européenne. Elle lie toujours les institutions de l’Union et les États membres, lorsqu’ils agissent dans le champ d’application du droit de l’Union. Toutefois, déterminer si une affaire concrète relève du champ d’application du droit de l’Union est loin d’être aisé. C’est pourquoi il est nécessaire de proposer des formations et du matériel pédagogique aux professionnels du droit, pour les aider à mieux comprendre le champ d’application de la Charte tel que défini en son article 51. Ce manuel du formateur a pour but de fournir des conseils sur l’organisation et la mise en oeuvre de ces formations, sur la base d’une série d’études de cas qui seront complétées à l’avenir.

Povelja Europske unije o temeljnim pravima predstavlja zbirku najvažnijih prava EU-a. Uvijek obvezuje institucije Europske unije i države članice kada djeluju unutar područja primjene prava EU-a. Međutim, nije lako procijeniti je li konkretan slučaj obuhvaćen područjem primjene prava EU-a. Stoga je pravnim stručnjacima potrebno omogućiti osposobljavanje i materijale za osposobljavanje kako bi razumjeli područje primjene Povelje kako je navedeno u njezinu članku 51. Cilj je ovog priručnika za instruktore pružiti smjernice i za organizaciju i provedbu takvog osposobljavanja na temelju niza studija slučajeva, koji će se u budućnosti proširiti.

Az Európai Unió Alapjogi Chartája (CFREU) az Európai Unió emberi jogi nyilatkozata. Minden esetben alkalmazandó az uniós intézményekre, az Unióra és az egyes tagállamokra, amikor azok az uniós jogszabályok keretében járnak el. Azt azonban egyáltalán nem könnyű megállapítani, hogy egy konkrét ügy az uniós jog hatálya alá tartozik-e vagy sem. Ezért szükséges az, hogy a jogi szakemberek számára képzést, illetve képzési anyagokat biztosítsunk, hogy megismerhessék a Charta alkalmazási körét, amelyet a Charta 51. cikke határoz meg. Ennek az oktatói kézikönyvnek az a célja, hogy a – későbbiekben bővíthető – esettanulmány-gyűjteményből kiinduló képzések megszervezéséhez és lebonyolításához iránymutatást nyújtson.

Het Handvest van de grondrechten van de Europese Unie is de bill of rights van de EU. Voor de EU-instellingen en lidstaten is het Handvest altijd bindend wanneer zij binnen de werkingssfeer van het Unierecht handelen. De beoordeling of een concreet geval binnen de werkingssfeer van het Unierecht valt, is echter verre van eenvoudig. Daarom is het nodig beoefenaars van juridische beroepen opleidingen en opleidingsmateriaal aan te bieden over het toepassingsgebied van het Handvest, zoals omschreven in artikel 51 daarvan. Karta praw podstawowych Unii Europejskiej („Karta”) jest unijnym katalogiem praw człowieka. Jest ona zawsze wiążąca dla instytucji UE i państw członkowskich, gdy działają one w ramach prawa UE. Nie jest jednak łatwo ocenić, czy konkretny przypadek wchodzi w zakres prawa Unii. Dlatego też konieczne jest zapewnienie szkoleń i materiałów szkoleniowych dla prawników praktyków, aby mogli oni zrozumieć zakres stosowania Karty określony w jej art. 51. Niniejszy podręcznik instruktora ma na celu dostarczenie wskazówek dotyczących zarówno organizacji, jak i realizacji takich szkoleń na podstawie studiów przypadków. Carta drepturilor fundamentale a Uniunii Europene (CDFUE) constituie Declarația UE a drepturilor. Aceasta are întotdeauna caracter obligatoriu pentru instituțiile UE și statele membre atunci când acționează în domeniul de aplicare al dreptului Uniunii. Nu este însă nici pe departe ușor să se aprecieze dacă o cauză concretă intră în domeniul de aplicare al dreptului Uniunii. Acesta este motivul pentru care este necesar să se asigure formarea practicienilor în domeniul dreptului și să se pună la dispoziția acestora materiale de formare ca să poată înțelege domeniul de aplicare al cartei, astfel cum este prevăzut la articolul 51. Acest manual pentru formatori își propune să ofere îndrumări privind atât organizarea, cât și implementarea unor astfel de ateliere de formare bazate pe o serie de studii de caz, care vor fi extinse în viitor.

Prípadové štúdie k charte – Príručka pre školiteľov
Charta základných práv Európskej únie (ďalej len „Charta“) je listinou práv pre EÚ. Vždy je záväzná pre inštitúcie EÚ, ako aj pre členské štáty, keď konajú v rozsahu pôsobnosti právnych predpisov EÚ. Nie je však ani zďaleka jednoduché posúdiť, či konkrétny prípad patrí do pôsobnosti práva EÚ. Preto je potrebné poskytnúť odborníkom pracujúcim v oblasti práva odbornú prípravu a materiály na odbornú prípravu, aby porozumeli oblasti uplatňovania Charty tak, ako sa stanovuje v jej článku 51. Cieľom tejto príručky pre školiteľov je poskytnúť usmernenia o organizácii a realizácii takýchto školení na základe série prípadových štúdií, ktoré sa v budúcnosti rozšíria.

Listina Evropske unije o temeljnih pravicah (Listina) je listina pravic EU. Za institucije EU in države članice je zavezujoča vedno, ko delujejo na področju uporabe prava EU. Vendar pa še zdaleč ni preprosto ugotoviti, ali konkretna zadeva spada na področje uporabe prava EU. Delavcem v pravni stroki je zato treba zagotavljati usposabljanje in gradivo za usposabljanje, da se jim omogoči razumevanje področja uporabe Listine, kot je določeno v njenem členu 51. Cilj tega priročnika za izvajalca usposabljanja je zagotoviti smernice tako o organizaciji kot o izvajanju takih usposabljanj na podlagi niza študij primerov, ki se bo v prihodnosti razširil.

Организациите на гражданското общество са изправени пред различни предизвикателства в целия Европейски съюз. Die zivilgesellschaftlichen Organisationen stehen in der gesamten Europäischen Union vor unterschiedlichen Herausforderungen. Der im September 2021 veröffentlichte Bericht der FRA über den Schutz des zivilgesellschaftlichen Raums in der EU enthält die Ergebnisse der Agentur zu diesen Herausforderungen. Die vorliegende Zusammenfassung stellt die wichtigsten Ergebnisse und FRA-Stellungnahmen aus dem Bericht vor.

Οι οργανώσεις της κοινωνίας των πολιτών έρχονται αντιμέτωπες με διάφορες προκλήσεις στις χώρες της Ευρωπαϊκής Ένωσης. Η έκθεση του FRA για την Προστασία του χώρου της κοινωνίας των πολιτών στην ΕΕ παρουσιάζει τα ευρήματα του Οργανισμού σε σχέση με τις εν λόγω προκλήσεις. Η έκθεση εκδόθηκε τον Σεπτέμβριο του 2021. Η παρούσα σύνοψη παρουσιάζει τα βασικά ευρήματα και τις γνώμες του FRA που επισημαίνονται στην έκθεση.
