Artigo 1.o- Dignidade do ser humano

A dignidade do ser humano é inviolável. Deve ser respeitada e protegida.

    A dignidade do ser humano constitui não só um direito fundamental em si mesma, mas também a própria base dos direitos fundamentais. Já a Declaração Universal dos Direitos do Homem de 1948 consagrava a dignidade do ser humano no seu preâmbulo: `Considerando que o reconhecimento da dignidade inerente a todos os membros da família humana e dos seus direitos iguais e inalienáveis constitui o fundamento da liberdade, da justiça e da paz no mundo`. No seu acórdão de 9 de Outubro de 2001, no processo C-377/98, Países Baixos contra Parlamento Europeu e Conselho, Colect. 2001, p. I-7079, nos pontos 70 a 77, o Tribunal de Justiça confirmou que o direito fundamental à dignidade da pessoa humana faz parte do direito da União.
    Resulta daí, designadamente, que nenhum dos direitos consignados na presente Carta poderá ser utilizado para atentar contra a dignidade de outrem e que a dignidade do ser humano faz parte da essência dos direitos fundamentais nela consignados. Não pode, pois, ser lesada, mesmo nos casos em que um determinado direito seja objecto de restrições.

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    As presentes anotações, inicialmente elaboradas sob a responsabilidade do Praesidium da Convenção que redigiu a Carta dos Direitos Fundamentais da União Europeia, foram actualizadas sob a responsabilidade do Praesidium da Convenção Europeia, à luz das adaptações ao texto (nomeadamente aos artigos 51.o e 52.o) da Carta introduzidas pela Convenção Europeia e da evolução do direito da União. Embora não tenham em si força de lei, constituem um valioso instrumento de interpretação destinado a clarificar as disposições da Carta.

    Artikel 23Ieder heeft het recht een menswaardig leven te leiden.
    Daartoe waarborgen de wet, het decreet of de in artikel 134 bedoelde regel, rekening houdend met de overeenkomstige plichten, de economische, sociale en culturele rechten, waarvan ze de voorwaarden voor de uitoefening bepalen.
    Die rechten omvatten inzonderheid :
    1° het recht op arbeid en op de vrije keuze van beroepsarbeid in het raam van een algemeen werkgelegenheidsbeleid dat onder meer gericht is op het waarborgen van een zo hoog en stabiel mogelijk werkgelegenheidspeil, het recht op billijke arbeidsvoorwaarden en een billijke beloning, alsmede het recht op informatie, overleg en collectief onderhandelen;
    2° het recht op sociale zekerheid, bescherming van de gezondheid en sociale, geneeskundige en juridische bijstand;
    3° het recht op een behoorlijke huisvesting;
    4° het recht op de bescherming van een gezond leefmilieu;
    5° het recht op culturele en maatschappelijke ontplooiing;
    6° het recht op gezinsbijslagen.

     Article 23 Chacun a le droit de mener une vie conforme à la dignité humaine.
    à cette fin, la loi, le décret ou la règle visée à l'article 134 garantissent, en tenant compte des obligations correspondantes, les droits économiques, sociaux et culturels, et déterminent les conditions de leur exercice.
    Ces droits comprennent notamment :
    1° le droit au travail et au libre choix d'une activité professionnelle dans le cadre d'une politique générale de l'emploi, visant entre autres à assurer un niveau d'emploi aussi stable et élevé que possible, le droit à des conditions de travail et à une rémunération équitables, ainsi que le droit d'information, de consultation et de négociation collective;
    2° le droit à la sécurité sociale, à la protection de la santé et à l'aide sociale, médicale et juridique;
    3° le droit à un logement décent;
    4° le droit à la protection d'un environnement sain;
    5° le droit à l'épanouissement culturel et social ;
    6° le droit aux prestations familiales.

    Article 23 Everyone has the right to lead a life in keeping with human dignity.
    To this end, the laws, federate laws and rules referred to in Article 134 guarantee
    economic, social and cultural rights, taking into account corresponding obligations, and
    determine the conditions for exercising them.
    These rights include among others:
    1° the right to employment and to the free choice of an occupation within the context
    of a general employment policy, aimed among others at ensuring a level of employment
    that is as stable and high as possible, the right to fair terms of employment and to fair
    remuneration, as well as the right to information, consultation and collective negotiation;
    2° the right to social security, to health care and to social, medical and legal aid;
    3° the right to decent accommodation;
    4° the right to the protection of a healthy environment;
    5° the right to cultural and social fulfilment;
    6° the right to family allowances.
