    Key facts of the case:

    The applicant was a Syrian national who arrived in Cyprus with two other persons and sought to apply for asylum. The authorities suspected that they might be involved in irregegular migration because of inconsistencies in their narrative. Through further questioning and investigation, the police identified that they might be jihadist fighters, including photos of himself with others in military uniforms and holding Kalashnikov, and issued search warrants and detention orders for reasons of national security. The applicant challenged these orders in Court. The police submitted confidential documents to the Court, which the applicant’s lawyer was only permitted to inspect on the spot. The applicant argued that the police detention order infringes Council Directive 2013/33/EC for not complying with the principles of necessity and proportionality and for not having been duly investigated and individually justified. The applicant further invoked infringement of article 6 of the Charter and article 5 of the ECHR, arguing that his detention was unnecessary and inconsistent with the ECHR jurisprudence, as it relied only on suspicions and speculations.

    Key legal question:

    Whether the detention order was issued in violation of the EU Charter, the ECHR, Council Directive 2013/33/EC and national law, for being unnecessary, disproportionate, inadequately researched or too generally justified.

    Outcome of the case:

    The Court endorsed the position that detention was imperative for public security reasons, pointing out that the detention order was individually justified and duly investigated. There was no infringement of either Charter article 6 or ECHR article 5 since the indications suggesting that the applicant may be a jihadist fighter were concrete, personalized and clear ,thus, providing legitimate reasons for placing the applicant under arrest.

    As to the substance, the applicant's attorney advanced in detail as grounds for invalidity of the detention at issue, the fact that, ... (b) The contested decision violates Article 6 of the Charter of Fundamental Rights of the European Union and Article 5 of the European Convention on Human Rights (hereinafter referred to as " ECHR "). This is particularly because the applicant's detention was not, in his view, necessary and consistent with the case law of the European Court of Human Rights (hereinafter 'the ECHR'), as it was based solely on suspicion and speculation.

    he respondents’ position that the detention at stake is necessary for the protection of national security is correct and I do not see, from the material before me, any indication of abuse or excess of authority or arbitrariness of the respondents’ request. The individual justification given for this, based on, I believe, due diligence and the interview with the applicant assisted by an interpreter in the Arabic language, as well as the conclusion that there are (serious, in my view) indications of a foreign jihadist fighter profile (that is, the applicant sustained injuries to various parts of his body and photographs of himself appearing along with other persons whom the applicant described as friends, all of whom are depicted holding AK47-Kalasnikov weapons and wearing military uniforms, in the light of the applicant's refusal to allow check of his mobile phone), is reasonable and consistent with the case law and with the Frontex guidelines (see Item 3 above). Guidelines which the Court, whether or not the respondents have invoked them in the process of evaluation of the contested decision, considers that it may also take into account as guidance, alongside the case-law, for the purposes of evaluating the correctness of the investigation carried out, compliance with the principles of proportionality and the likelihood of any error in the decision at stake. In light of the foregoing, I consider that the contested order was lawfully and reasonably issued citing Article 9F(2)(e) of the Law, namely the protection of national security, and was necessary and proportionate to the aim pursued (see Article 52(2) of the General Principles of Administrative Law, Law 158 (I) / 1999). The potential alternatives to the applicant’s detention, as set out in Article 9F (3) of the Law (above), which are indeed less invasive and burdensome for his rights [see also Article 53 (3) of Law 158 (I)/1999], could not in my view effectively serve the purpose of protecting national security in the present case and for this reason the respondents were right in not selecting these at the moment of the adoption of the contested decision.

    Nor, in light of the foregoing, is there a valid issue of a breach of either Article 6 of the Charter of Fundamental Rights of the European Union or of Article 5 of the ECHR, since the abovementioned indications that the applicant fits the profile of a fighter-jihadist were specific, concrete and individualized.

    Επί της ουσίας, η πλευρά του αιτητή προώθησε αναλυτικά ως λόγους ακυρότητας της επίδικης κράτησης, ότι, … β) Η επίδικη απόφαση παραβιάζει το άρθρο 6 του Χάρτη Θεμελιωδών Δικαιωμάτων της Ευρωπαϊκής Ένωσης και το άρθρο 5 της Ευρωπαϊκής Σύμβασης των Δικαιωμάτων του Ανθρώπου (εφεξής «ΕΣΔΑ»). Αυτό, κυρίως, διότι, η κράτηση του αιτητή, κατά τον ίδιο, δεν ήταν αναγκαία και συμβατή με τη νομολογία του Ευρωπαϊκού Δικαστηρίου Ανθρωπίνων Δικαιωμάτων (εφεξής «ΕΔΑΔ»), αφού στηριζόταν απλά σε υπόνοιες και εικασίες.

    Η θέση της καθ' ης η αίτηση, ότι η επίδικη κράτηση επιβάλλεται για την προστασία της εθνικής ασφάλειας, είναι ορθή και δεν διακρίνω, από το ενώπιον μου υλικό, οποιαδήποτε ένδειξη κατάχρησης ή υπέρβασης εξουσίας ή αυθαιρεσία της καθ' ης η αίτηση. Η εξατομικευμένη αιτιολογία που δόθηκε περί τούτου, με βάση, κρίνω, δέουσα έρευνα και τη συνέντευξη του αιτητή με την βοήθεια διερμηνέα στην αραβική γλώσσα που διεξήχθη, καθώς και η κατάληξη ότι υφίστανται (σοβαρές, κρίνω) ενδείξεις για προφίλ ξένου μαχητή-τζιχαντιστή (δηλαδή ότι ο αιτητής έφερε τραύματα σε διάφορα μέρη του σώματος του και σε φωτογραφίες του, στις οποίες εμφαίνεται ο ίδιος μαζί με άλλα πρόσωπα, τους οποίους ο αιτητής περιέγραψε ως φίλους του, όλοι τους απεικονίζονται με όπλα ΑΚ47-Καλάσνικοφ και φέρουν στρατιωτικές στολές, σε συνάρτηση και με την άρνηση του αιτητή να επιτρέψει τον έλεγχο του κινητού τηλεφώνου του), είναι εύλογη και συνάδουσα με τη νομολογία, αλλά και με τις κατευθυντήριες γραμμές περί τούτου και της Frontex (βλ. Τεκμήριο 3, ανωτέρω). Κατευθυντήριες γραμμές, τις οποίες το Δικαστήριο, ανεξαρτήτως αν έγινε επίκληση τους ή μη από την καθ' ης η αίτηση στην διαδικασία παραγωγής της επίδικης απόφασης, κρίνω ότι δύναται να τις λάβει και αυτές υπόψη ως καθοδηγητικές, όπως και τη σχετική νομολογία, για σκοπούς διάγνωσης της ορθότητας της διεξαχθείσας έρευνας, της τήρησης των αρχών της αναλογικότητας και της πιθανολόγησης τυχόν πλάνης στη λήψη της επίδικης απόφασης. Υπό τα πιο πάνω δεδομένα, κρίνω ότι, το επίδικο διάταγμα νόμιμα και δικαιολογημένα εκδόθηκε κατ' επίκληση του 9ΣΤ (2) (ε) του Νόμου και δη, της προστασίας εθνικής ασφάλειας και ήταν αναγκαίο και ανάλογο προς τον επιδιωκόμενο σκοπό (βλ. άρθρο 52 (2) του περί των Γενικών Αρχών του Διοικητικού Δικαίου Νόμου, Ν. 158(Ι)/1999). Οι δυνητικές εναλλακτικές επιλογές αντί της κρατήσεως του αιτητή, ως αυτές καθορίζονται στο άρθρο 9ΣΤ (3) του Νόμου (ανωτέρω), οι οποίες είναι, όντως, λιγότερο επεμβατικές και λιγότερο επαχθείς για τα δικαιώματα του (βλ. και άρθρο 53(3) του Ν. 158 (Ι)/1999), κρίνω, ότι δεν θα μπορούσαν, στη συγκεκριμένη περίπτωση, να εξυπηρετήσουν αποτελεσματικά τον σκοπό της προστασίας της εθνικής ασφάλειας και για αυτό τον λόγο ορθώς δεν επιλέγηκαν από την καθ' ης η αίτηση, κατά τη χρονική στιγμή της έκδοσης της επίδικης απόφασης. Ούτε, με βάση τα προαναφερθέντα, τίθεται βάσιμα ζήτημα παραβίασης είτε του άρθρου 6 του Χάρτη Θεμελιωδών Δικαιωμάτων της Ευρωπαϊκής Ένωσης είτε του άρθρου 5 της ΕΣΔΑ, αφού οι προαναφερόμενες ενδείξεις για πλήρωση από τον αιτητή του προφίλ μαχητή-τζιχαντιστή ήταν συγκεκριμένες, εξατομικευμένες και σαφείς.
