Article 21 - Non-discrimination

1. Est interdite toute discrimination fondée notamment sur le sexe, la race, la couleur, les origines ethniques ou sociales, les caractéristiques génétiques, la langue, la religion ou les convictions, les opinions politiques ou toute autre opinion, l'appartenance à une minorité nationale, la fortune, la naissance, un handicap, l'âge ou l'orientation sexuelle.
2. Dans le domaine d'application des traités et sans préjudice de leurs dispositions particulières, toute discrimination exercée en raison de la nationalité est interdite.

    Le paragraphe 1 s'inspire de l'article 13 du traité CE, désormais remplacé par l'article 19 du traité sur le fonctionnement de l'Union européenne, et de l'article 14 de la CEDH ainsi que de l'article 11 de la convention sur les droits de l'homme et la biomédecine en ce qui concerne le patrimoine génétique. Pour autant qu'il coïncide avec l'article 14 de la CEDH, il s'applique conformément à celui-ci.
    Il n'y a ni contradiction ni incompatibilité entre le paragraphe 1 et l'article 19 du traité sur le fonctionnement de l'Union européenne, dont le champ d'application et l'objet sont différents: l'article 19 confère à l'Union compétence pour adopter des actes législatifs, y compris l'harmonisation des dispositions législatives et réglementaires des États membres, afin de combattre certaines formes de discrimination qui sont citées d'une manière exhaustive dans cet article. Cette législation peut s'étendre à l'action des autorités d'un État membre (ainsi qu'aux relations entre les particuliers) dans tout domaine entrant dans les compétences de l'Union. En revanche, le paragraphe 1 de l'article 21 ci-dessus ne confère aucune compétence pour adopter des lois antidiscrimination dans ces domaines de l'action des États membres ou des particuliers, pas plus qu'il n'énonce une large interdiction de la discrimination dans lesdits domaines. En fait, il ne concerne que les discriminations qui sont le fait des institutions et organes de l'Union, dans l'exercice des compétences que leur confèrent les traités, et des États membres, uniquement lorsqu'ils mettent en œuvre le droit de l'Union. Le paragraphe 1 ne modifie dès lors pas l'étendue des compétences conférées par l'article 19 ni l'interprétation de cet article.
    Le paragraphe 2 correspond à l'article 18, premier alinéa, du traité sur le fonctionnement de l'Union européenne et doit s'appliquer conformément à celui-ci.

Elles ont été mises à jour sous la responsabilité du praesidium de la Convention européenne, compte tenu des adaptations apportées au texte de la Charte par ladite Convention (notamment aux articles 51 et 52) et de l'évolution du droit de l'Union. Bien que ces explications n'aient pas en soi de valeur juridique, elles constituent un outil d'interprétation précieux destiné à éclairer les dispositions de la Charte.
